Santosh Kumar Chauhan had suffered serious head injuries when a taxi hit him while walking along Ashram Chowk a decade ago.
Since then, he had been running from pillar to post to claim compensation. Chauhan thought his battle was over when the Motor Accident Claims Tribunal awarded Rs 34,000 in April.
But the matter did not end there. The insurance firm, Oriental Insurance Company , filed a counter appeal. The reasons cited — the offending taxi was not insured on the date of accident, the driver had no licence to drive a taxi, there is a distinction between a private vehicle, transport vehicle, etc.
Imposing a fine of Rs 10,000 on the insurance company, Justice V Gupta said: ”Instead of awarding the amount which will be meagre to the company, the insurance company is after his blood and has filed the present appeal.”
